You have nothing to fear, as long as you follow the simple guidelines (outlined below) and using our e-mail template design service will guarantee this.

Adherence to these anti-spam guidelines will ensure;

• maximum deliverability of your e-mail messages

• compliance with all applicable legislation

• successful e-mail marketing through building long term trust based relationships with your subscribers

• and will position yourselves as a professional & ethical company with whom they will be confident to do business
  

Our Policy

• To whom can we already legally send e-mail communication? – to existing customers, and those who have previously requested information (e.g. a brochure) or made an enquiry. Your e-mail content should relate to the same type of product/service i.e. a purchaser of car insurance cannot be e-mailed information on health care products

• SPAM is unsolicited e-mail, commercial or non-commercial. In other words, any e-mail sent to people without their prior permission.

• Sending SPAM is illegal - "The Privacy and Electronic Communications (EU Directive), 2003"

• Ace Web Marketing (UK) Ltd operate a strict zero tolerance NO-SPAM Policy

• E-mail Marketer© is to be used only for 100% opt-in permission based e-mail marketing

• Clear guidance is given below so that you can ensure that you comply fully with current e-mail legislation and our NO-SPAM Policy.

• Full agreement with our No-SPAM Policy and terms & conditions is essential prior to the purchase and use of E-Mail Marketer.

• By purchasing E-mail Marketer©, you are deemed to have read and fully accepted our No-SPAM Policy and terms & conditions and responsibility for full adherence lies completely with you the originating client (i.e. sender of the e-mail, not with us the technology provider).

• In the situation (we monitor all e-mail marketing activity) where a client is found guilty of any Spamming activity (i.e. not fully complying with the clear guidance given within this document), they are in breach of this policy and therefore our terms & conditions. Therefore, we reserve the right, at our sole discretion, to de-activate their account, and no reduction or refund of fees will be made.

• Full responsibility for an e-mail campaign (it all its different aspects) lies fully with you the originating client (i.e. sender of the e-mail, not with us the technology provider).

Anti-Spam Guidelines

Full compliance with each of these guidelines is a mandatory condition in order to use E-mail Marketer©. Keeping to these guidelines will avoid you being accused of any SPAM activity and will ensure the best results in terms of improved sales, customer relationships, and profitability.

Using our e-mail template design service will ensure you meet all the required guidelines.

The guidelines are;

Every e-mail sent should;

• include a fully functioning unsubscribe link and clear unsubscribe instructions

• have legitimate & current contact details (telephone number & postal address)

• have valid “From” and “Reply-To” e-mail addresses

• avoid any false or misleading information in the subject line or main message

Also…

• Most unsubscribe requests will be automatically processed by E-mail Marketer©, but any manual requests required must be actioned – you must not continue to e-mail anyone who has requested to be removed from your list
  
• All domain names & e-mail addresses used must be real, current and fully active.

• There must be no attempt to misrepresent, hide, or obscure the point of origin or transmission path of the e-mail, or true origin of the sender

• You must not use a 3rd parties domain name or e-mail address without express prior permission
  

Purchased/Imported Lists

• Some providers simply ban the use of purchased/rented lists because there are unethical providers who say that a list is opt-in when it is nothing of the sort. However in recognition that there are legitimate 100% opt-in list providers, we do allow the use of purchased/rented lists, but you must contact us for approval prior to use.

• Failure to obtain our approval for the use of purchased/rented lists constitutes a breach of this policy and therefore our terms & conditions. In this scenario, we reserve the right, at our sole discretion, to de-activate the account (no reduction or refund of fees will be made), and re-activation will only occur when all of the purchased/rented list contacts have been removed and we have your written confirmation that no further purchased/rented lists will be used prior to our approval.

• Content sent to 100% opt-in permission based purchased/rented lists must relate to the same product/service that the list subscribers gave contact permission for i.e. a list of subscribers who gave permission to receive information on car insurance cannot be e-mailed information on health care products

• Whilst we will do our best to evaluate the legality of a purchased/rented list, full responsibility for the use of any such list lies completely with you the originating client (i.e. sender of the e-mail, not with us the technology provider).
  

Nature of E-mail Content

• The content of e-mails is fully the responsibility of the originating client (i.e. sender of the e-mail, not with us the technology provider).

• Given the nature of our professional clients, we do not anticipate any issues in respect of the legality & nature of e-mail content, but for policy completeness we must state that content of the following nature is not allowed: pornography, bestiality, sexually indecent or obscene, no content that incites hate or terrorism on any grounds (e.g. defined by reference to colour, race, nationality (including citizenship) or ethnic or national origins), no libel, no plagiarism.

• We reserve the right, at our sole discretion, to decide whether content breaches the above condition.

• In the situation where content is found to be in breach of our terms, we reserve the right, at our sole discretion, to de-activate the account, and no reduction or refund of fees will be made.
